10. Muscat Duty Free Store Rules

10.1. Eligibility

10.1.1. The ‘Muscat Duty Free Store’ is the reward section of the web site of the Sindbad program and this is owned and operated by the Oman Sales and Services LLC that manage the Muscat Duty Free at Muscat International airport. The use of the Muscat Duty Free Store’ is exclusively for Sindbad Members who can enter into legally binding agreements under the applicable law. The rules relating to the use of the Muscat Duty Free Store are set out below.

10.1.2 To be eligible to redeem your miles and purchase products or services through the ‘Muscat Duty Free Store’, you must be a Sindbad member at least 18 years of age. In case members under the age of 18 purchase products on the Muscat Duty Free store the product will not be handed over to the member. 

10.1.3. By accessing this site and making transactions through the Muscat Duty Free Store, specifically by clicking the "I Agree" button, you expressly indicate your acknowledgment and acceptance of the rules applicable to the Muscat Duty Free Store for the purchase of ‘Non-Flight Rewards’.

10.1.4. Non-Flight Rewards consist of any goods or services purchased by you from Muscat Duty Free that make available such Rewards directly to you via the Muscat Duty Free Store. Taking advantage of these services you will be entering into a legal relationship with Muscat Duty Free. To the extent permitted by law, Oman Air excludes all liability to you or other person of whatsoever nature in respect of any negligence, willful misconduct, poor service or other breach of obligation arising out of the provision or failure to provide the services by or on behalf of Muscat Duty Free. Your legal relationship is with Muscat Duty Free and not with Oman Air.

10.2. Relationship between You and Muscat Duty Free

10.2.1. Every time you purchase a Reward via the Muscat Duty Free Store, you directly enter into an agreement with the Muscat Duty Free. Oman Air only provides the access and the technical platform for you to directly redeem Rewards from Muscat Duty Free. Neither Oman Air nor any of its staff becomes party to the transaction between you and the Merchant.

10.3. Reward Payment

10.3.1 When purchasing Rewards via the Muscat Duty Free Store, you will pay for such Rewards with Sindbad miles provided that you have sufficient Sindbad miles available in your account at the time of purchasing a Reward. Sindbad miles that are not yet accrued and credited to your account at the time you place the purchase order are not available for the purchase. Sindbad miles are deducted from your account as soon as the Reward is purchased.

10.3.2 The amount of Sindbad miles necessary for the purchase of a Reward is determined by Oman Air and Oman Air has the right, at any time, to change the amount of miles necessary to purchase a Reward in the Store. Any transactions concluded prior to any change will however be honored.

10.3.3 The conversion of Sindbad miles into a cash amount and the payment of such cash amount to you or any similar transaction is not possible, not even in case where you may return the product or cancel your Sindbad membership.

10.3.4 In case the purchase for a reward is interrupted and the confirmation page is not displayed, you must repeat the purchase process.

10.3.5 Sindbad reserves the right to cancel a reward, for any reason, before or after all or some of the items have been sold. In these circumstances Oman Air will return the miles debited for purchase of items to applicable members without obligation to pay any interest whatsoever.

10.4. Terms of Reward Redemption

10.4.1. In case of purchase of a Reward via the Muscat Duty Store and if such order has not arrived at the delivery location on the day of delivery, Oman Air may, upon a written request from you which should be received within 30 days of the agreed delivery date, cancel and replace such order, provided you submit a request to Sindbad@omanair.com. Upon receipt of such a request, Oman Air will initiate a review process.

10.4.2. Where indicated, the prices on the Store include all the charges.

10.5. Returned, Delayed and Defective, Uncollected Goods Rewards

10.5.1. In the event of purchasing Rewards in the Muscat Duty Free Store, you expressly agree and accept that any claim, compensation or damage for wrong or delayed handling and for returned, defective or faulty Rewards can only and exclusively be made against Muscat Duty Free, in accordance with their terms and conditions. Any complaints for delayed deliveries or returned, defective or faulty Rewards shall be addressed by you to Muscat Duty Free.  Oman Air will however use its best endeavors to initiate a review process if informed by you of any such issues.

10.5.1. Returns must be made immediately, in the same condition in which you received the rewards and at your own cost and risk. If following investigations of the matter it is agreed as between you and Muscat Duty Free that you shall be refunded, refunds will be in the form of Sindbad miles which are the original method of payment.

10.5.2 Oman Air will not accept any liability for any loss, damage or disappointment suffered by any member as a result of purchasing an item on the Muscat Duty Free Store.

10.5.3 If you fail to collect your ordered product(s) within ninety (90) days of the date of placing your order, Muscat Duty Free may, at its discretion, cancel the order and you will not be entitled to the refund of any Sindbad miles.

10.6. No Warranties

10.6.1. All Rewards and other content on the Site or displayed in the Muscat Duty Free Store or obtained from websites linked to the Site or the Store ("linked site") are provided to you on an "as is" basis without warranty of any kind on the part of Oman Air either expressed or implied including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose, title, non-infringement, security or accuracy.

10.6.2. Oman Air does not warrant or represent that the content on the Site or any linked site is complete or up-to-date. Oman Air is under no obligation to update any content on the site or any linked site. Oman Air may change the content on or make improvement or changes of the Site at any time without notice.

10.7. Limitations of Liability

10.7.1. The information, products, and descriptions of Rewards and other services published on the Site or a linked site may include inaccuracies or typographical errors, and Oman Air specifically disclaims any liability for such inaccuracies and errors. Other than as required under applicable laws, under no circumstance will Oman Air be liable for any loss or damage caused by your reliance on information obtained through the Store.

10.7.2. You agree that Oman Air, its affiliates and any of their staff or agents will not be liable, whether in contract, tort, strict liability or otherwise, for any indirect, punitive, special, consequential, incidental or indirect damages (including without limitation lost profits, cost of procuring substitute service or lost opportunity) arising out of or in connection with the use of the Site or a linked site, or with the delay or inability to use the Muscat Duty Free Store, even if Oman Air is made aware of the possibility of such damages.

10.7.3. Oman Air cannot and do not guarantee continuous, uninterrupted or secure access to the Muscat Duty Free Store Site or the linked sites.

10.7.4. Oman Air reserves the right to seek all remedies available at law and in equity for any misuse of the Muscat Duty Free Store and/or violations of these rules, including the right to block access from a particular Internet address to the Site and to exclude you from accessing the Muscat Duty Free Store.

10.8    Order Lead Time

10.8.1    Sindbad members shall register their orders a minimum of 24 hours prior to the scheduled departure time or arrival time at Muscat International Airport.

10.9    Collection / Delivery Point

10.9.1    Delivery point for items purchased will be either at Muscat Duty Free’s main shop at departures first floor or arrival duty free outlet at Muscat International Airport which need to be specified at the time of placing the online order.  Due to Customs regulations, we are not able to deliver products outside the airside of Muscat International Airport.

10.9.2    Sindbad members are required to produce their valid Sindbad membership card (if the products are collected by the Sindbad member himself / herself) and in the event of collection by a nominee passport of the nominee, together with a copy of the online order notification form generated from the website.

10.10    Duty Free Allowance & Security Regulations

10.10.1 In the event of collection point at arrivals, items purchased should be within local arrivals Customs allowance. 

10.10.2 In accordance with Customs laws in Oman purchase and collection of liquor from the merchant will be restricted to persons over the age of 21.  The delivery point being the Muscat Duty Free outlets at Muscat International Airport, Sindbad members are required to strictly comply with local customs regulations in purchasing products. Please refer to the applicable customs allowance in Oman. Neither Oman Air nor the merchant will be liable for confiscation of products or any fines by Customs due to non-compliance to the stipulated local customs regulations.

10.11    Order Holding Period

10.11.1 Sindbad members are required to collect the ordered items within a period of 90 days from the date of order.  At its discretion Muscat Duty Free Oman Air may cancel an order after such ninety (90) day period. In such cases, where the order is not collected beyond 90 days, member will not be entitled to the refund of any Sindbad miles.
